LabelyPrint software licence terms
Rules for the use of the LabelyPrint software. Effective on the date of publication; the current wording is always published on this page.

The provider and author of the LabelyPrint software (a print application for label design and printing) is IDENTIX SYSTEM s.r.o., Company ID: 24988430, file reference C 151294 kept at the Regional Court in Brno (the "Provider").
2. Subject of the licence
The LabelyPrint software is a copyrighted work protected under Act No. 121/2000 Coll., the Czech Copyright Act.
By purchasing a licence, the customer acquires only the right to use the software within the scope of these terms. All copyright remains with the Provider.
3. Licence types
Standard
The licence is intended for installation and use on one (1) computer or workstation for one (1) user.
Pro
The licence is intended for installation and use on one (1) computer or workstation for one (1) user.
Enterprise
A network licence provided under an individual contract with individually agreed conditions.
The types of newly purchased licences and their features may change without prior notice. The current licence types and features are always listed at www.labelyprint.cz.
4. Printers
A single licence entitles the user to print on an unlimited number of supported printers connected to the licensed workstation (see Licence types above).
5. Prohibited uses
The user is not entitled to:
- sell, rent or provide the software to third parties,
- transfer the licence without the Provider's consent,
- decompile, analyse or modify the LabelyPrint software,
- circumvent licence protections or otherwise exploit bugs in the licence server or licence,
- remove copyright or identification markings,
- run the licence on a server, PC or other workstation that provides remote access for multiple users from other devices who could use the licence collectively.
6. Updates
Every newly purchased licence entitles the holder to automatic updates for a period of 12 months from licence activation.
After this period expires, the user may purchase the Support service, which entitles the holder to receive new versions and updates of the program for a further 12 months.
The Support service does not include technical support, training, consulting or service work.
If the user has no active Support, the software may continue to be used, but without entitlement to new updates.
Updates fix bugs from earlier versions and may add new features to previously purchased licences. The condition is having active automatic updates (included with each new licence for 12 months) or an active Support service as described above.
7. Liability
The software is provided "as is".
The Provider gives no warranty of uninterrupted operation, error-free software or fitness for the user's particular purpose.
The Provider is in particular not liable for:
- loss of data,
- damage to databases,
- interruption of operations,
- loss of orders,
- lost profit,
- loss of business opportunities,
- indirect, consequential or related damages,
- damage caused by incorrect device configuration,
- damage caused by third-party software or hardware,
- damage caused by incorrect use of the program by the user.
The LabelyPrint software is not intended for use in systems, devices or operations where its failure, malfunction or unavailability could endanger life, health, cause an environmental disaster or result in significant property damage.
The user uses the software at their own responsibility and is obliged, before deploying to production, to verify the correctness of all designs, settings and print outputs.
The user is in particular obliged to verify the correctness of:
- label designs,
- 1-D barcodes,
- 2-D codes,
- database connections,
- imported data,
- variable fields,
- print templates,
- printed outputs.
The Provider is not liable for damages arising from:
- incorrectly designed labels,
- incorrectly printed labels,
- incorrectly used labels,
- incorrect 1-D or 2-D codes,
- incorrect data entered by the user,
- incorrect data obtained from external databases or information systems,
- incorrect configuration of printers or printing devices.
The Provider is furthermore not liable for any costs, losses or damages related to reprinting of labels, production of defective products, incorrect goods identification, logistics errors, warehouse errors, customer claims or other consequential business impacts arising from use of the software.
The Provider is not liable for the accuracy, completeness or usability of data, labels, 1-D barcodes, 2-D codes, database records or other outputs created by the user through the software.
The Provider's maximum aggregate liability for all claims arising in connection with use of the software is limited to the amount of the licence fee actually paid by the customer for the given licence.
This limitation of liability applies to the fullest extent permitted by the laws of the Czech Republic.
8. Data backup and protection
8.1. The user acknowledges that they are responsible for regular back-up of all data related to their use of the LabelyPrint software, in particular label designs, databases, print templates, configuration files, program settings and other user data.
8.2. The Provider strongly recommends performing regular back-ups before installing program updates, changing system configuration, migrating data or otherwise altering the operating environment.
8.3. The Provider is not liable for loss, damage, unavailability or corruption of data caused in particular by:
- hardware failure,
- operating-system fault,
- database-system fault,
- power outage,
- network outage,
- malware attack,
- cyber attack,
- third-party error,
- incorrect device configuration,
- user error,
- force majeure.
8.4. The Provider bears no liability for costs of data recovery, operations recovery, recreating print templates, reprinting labels or any related damages or losses.
8.5. The user acknowledges that LabelyPrint serves as a tool for label design and printing and does not replace systems intended for archiving, backup or long-term storage of data.
8.6. If the software includes export, import or backup features, the user is obliged to verify that the created backups are correct and usable for data recovery.
8.7. The Provider gives no warranty that data created or stored via the software will be recoverable after a system failure, device damage or other extraordinary event.
9. Termination of the licence
The Provider may terminate the licence upon material breach of these terms. An example of a material breach is Article 5, Prohibited uses.
Upon termination the user is obliged to uninstall the software and cease its use without further delay.
10. Governing law
All legal relations are governed by the law of the Czech Republic.
Any disputes shall be resolved by the competent courts of the Czech Republic.
11. Final provisions
The Provider reserves the right to reasonably amend the licence terms.
